Lucky Draw Terms and Conditions

1. Lucky draw date: Friday, October 1st, 2010.

2. All required fields (indicated by an asterisk) on gift card program must be complete upon submission to be considered for gift cards. All forms submitted without required information will be considered incomplete and not eligible for gift cards. U.S. Bankcard Services, Inc. (USBSI) reserves the right to refuse redemption for all incomplete submission forms.

3. Winners will be notified via email or U.S.P.S. certified letter. All gift cards must be claimed by Wednesday, December, 1st, 2010. Winners must complete redemption procedures as outlined in “Winner’s Package” to receive the gift card. Winners are responsible for all shipping fees, if applicable.

4. Usage of gift cards shall be limited to card issuer’s terms and conditions.

5. Unless forbidden by law, winners who receive prizes shall authorize USBSI, its subsidiaries, and agents to use the winner’s names, voice, performance, photograph/video, image, and/or likeness for programming, advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by USBSI and its designees, without compensation (unless prohibited by law) or additional consents from entrant or any third party and without prior notice, approval or inspection, and to execute specific consent to such use if asked to do so.

6. Winners shall comply with all related federal, state and local law and regulations, and file tax when applicable. Winners will receive an IRS 1099 tax form for the prize. Foreign winners will be subject to a tax pre-deduction before they can receive their prize.

7. USBSI accepts no liability for misprints during the campaign or any of the campaign contents and materials.

8. Any legal action including arbitration or any action for declaratory relief brought by Merchant or Consumers against USBSI, or by USBSI against Merchant/Consumers, shall be taken to a Court of Law in the State of California, County of Los Angeles. If any legal action, including arbitration or an action for declaratory relief, is brought to enforce the provisions of the terms and conditions of this campaign, Merchant/Consumers agree to pay USBSI all reasonable attorney’s fees, expenses, costs and other relief, which may be set by the court in the same action or in a separate action brought for that purpose. This includes but is not limited to, campaign disputes, rules and regulations, legal procedures, or other similar events, whether the fees or costs are incurred during or after the term of this campaign. This provision applies to the entire campaign.

9. USBSI reserves the right to extend, modify, alter, or cancel this event, for any reason, with or without explanation, and all decisions will be posted on USBSI website (www.usbsi.com) before execution, and no further information shall be provided. USBSI reserves the right to render all decisions and all decisions rendered by USBSI are final.

10. USBSI employees, their families and household members are not eligible for “Lucky Draw” contest.

11. Agreement to the above Terms and Conditions. Participation in the Promotion constitutes your full and unconditional agreement to these Terms and Conditions and the decisions of Sponsors, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein in a timely manner.
